BOSTON, MA – Today, the National Association of Government Employees (NAGE) applauds the passage of House Bill 3825, “An Act Relative to Collective Bargaining Dues.”

NAGE National President David Holway states, “On behalf of the working women and men of NAGE, I first want to thank Speaker DeLeo and the members of the Massachusetts House of Representatives for their leadership in voting to pass House Bill 3825.  The passage of House Bill 3825 represents a huge step forward for the labor movement in Massachusetts. NAGE is particularly proud to have led the way on this legislation from the very beginning, working with Rep. Tackey Chan to file the bill that would carry the necessary legislative response to Janus.  NAGE will remain at the forefront of the fight for fair wages, livable benefits and the preservation of our working and middle-class families.  From leading the fight for card check a decade ago, his support for OSHA protections for public employees, to holding the line on state employee health insurance, and now leading the House to an important response to Janus, Speaker DeLeo has been an ally and a friend. It is reassuring to know that we continue to have a strong partner in the Massachusetts Legislature.”

The Janus response legislation was first filed by Representative Tackey Chan at the request of NAGE in anticipation of the Friedrichs case, which was later remanded to the Appeals Court after the death of Justice Scalia. “NAGE has been working to prepare for Janus for several years and with passage of today’s bill, we look forward to working with the Senate and Governor to hopefully finalize it in the near term,” states NAGE President Holway. 

Holway explained that the bill served as an essential response to update our state labor statute in the wake of the Supreme Court overturning 4 decades of precedent.  “The Supreme Court gave very clear guidance that an employee organization could charge non-members for individual service, however, we needed to amend the state collective bargain law to reflect what Janus says at the local level.

 Additionally, because Janus maintains that unions must continue to treat all members of a bargaining unit equitably, it is imperative that we be able to communicate with members and non-members alike in order to meet our legal obligations.  House Bill 3825 ensures that we will be able to maintain our standards of communication and service.
